Medicaid planning can be a bad dream for any couple. But if you’re part of a gay or lesbian couple, it can be a genuine nightmare!
The process of applying for Medicaid is actually one of the most dangerous parts of Elder Law…because if you don’t do it correctly, it can drain you of every cent you’ve got.
I’ve been in the practice of Elder Law for 33 years. During that time, my office has crafted wills, trusts, Powers of Attorney, long-term care and assisted living plans, Medicaid and VA assistance plans, asset protection plans…basically, plans to protect my clients as they age.
But it still makes me want to scream when someone says to me, “Is it true we didn’t need to spend our life savings on nursing-home care?”
Yes, it’s true! They didn’t need to spend their life savings on nursing-home care! Which they would have known if they had called me first.
I could have spared them the pain. I could have shown them how to preserve their hard-earned assets. I could have shown them how to qualify for Medicaid…without having to “spend down” their money.
If you’re married, Medicaid planning affords you many more benefits in crisis situations. But if you’re part of a non-traditional couple, and not married, these benefits aren’t available. For example, if you have money held jointly – even if it really belongs to only one of you – Medicaid says it belongs to both of you. And this can be a disaster!
If you’re part of a non-traditional couple, “traditional” Medicaid planning might be useless. The rules are different. You may not have a traditional “family,” which means you have to create your own. The best person to advise you is an Elder Law attorney, who can steer you clear of all the potholes on the road – because the government’s just waiting for you to screw up!
